DATA PROTECTION POLICY

This Data Protection Policy sets out how Nissin Foods Asia Co., Ltd. and Nissin Foods (Thailand) Co., Ltd. (hereinafter, the “Company”) handle and process the Personal Data of our customers, partners, suppliers, employees, workers and other third party (hereinafter, “You”) in order to comply with Personal Data Protection Act B.E. 2562 (2019). This Data Protection Policy shall apply to all Personal Data with respect to the collection, use or disclosure including the retention period, erasure and deletion of personal data regarding the rights of data subjects’ protection.

As the Company is based in Thailand, The Company declares that, concerning the personal data processed in its operations, we observe the laws, regulations, and other rules regarding the protection of personal data. We also establish rules and systems of our own, and provide, implement, and maintain our privacy policy as mentioned below.

1. Definitions

Personal Data
Personal Data means any information relating to a person, which enables the identification of such Person, whether directly or indirectly, but not including the information of the deceased Persons in particular.

Data Controller
Data Controller means a person or a juristic person having the power and duties to make decisions regarding the collection, use, or disclosure of the personal data. For the purpose of this Data Protection Policy, we are a Data Controller of your Personal Data.

Data Processor
Data Processor means a person or a juristic person who operates in relation to the collection, use, or disclosure of the personal data pursuant to the orders given by or on behalf of a data controller, whereby such person or juristic person is not the data controller.

Person
Person means a natural person.

2. Personal data to be collected by our company

2.1 The company may ask you to provide us with certain personal data and/or may collect the following personal data for various purposes as specified in clause 4.1. herein:

  • (a) information necessary to perform our obligations in accordance with any contract that we may have with you or the organization you represent;
  • (b) information necessary to fulfil your orders;
  • (c) information you give us in forms or surveys;
  • (d) Personal Data including, name and surname, the date and place of birth, marital status, information contained in an individual’s citizen identity card, passport and their copies;
  • (e) contact information including, address, telephone number, social media identification such as Line ID, and workplace contact details;
  • (f) information related to electronic systems access and usage such as email, IP Address, Browsers, Cookies and chat history in various application;
  • (g) information about your visits to our premises and events;
  • (h) information necessary to purchase products;
  • (i) information about your preferences and interests;
  • (j) information necessary to verify your identity and age;
  • (k) information you give us when you apply for a job with us;
  • (l) information you give us when you make enquiries by email, telephone, fax or post; and
  • (m) information necessary to provide you with press releases, e-mail alerts, or marketing communication.


2.2 Where required, the Company may collect Personal Data about other persons (from whom you have obtained consent to provide such data to us in accordance with this Policy).

2.3 The Company will not process any special (or sensitive) categories of Personal Data or personal information relating to criminal convictions or offences except where we are able to do so under applicable laws or with your explicit consent.

2.4 Your provision of Personal Data to the Company is voluntary and you may at any time withdraw your consent for our use and disclosure of the Personal Data you provide. You are responsible for and must ensure that all Personal Data that you provide is true, accurate and complete.

3. Source of Personal Data

3.1 You will either be asked to explicitly consent to our collection, use, and/or disclosure of your Personal Data or otherwise informed of the lawful basis on which such collection, use, and/or disclosure is based.

3.2 We may receive your Personal Data from any of the following sources:

  • 3.2.1 Personal Data you provide to us: You may give us your Personal Data directly. This is often the case where you contact us with enquiries, complete forms online, website , by hand, subscribe to receive our marketing communications or provide feedback to us.
  • 3.2.2 We have directly received the Personal Data from you and we will collect your Personal Data from the process of our business or service as follows:
    • a. the process of registration for the use of our service or procedure to file a claim to exercise rights against us;
    • b. from your voluntary intention via survey, email or any other communication channel between you and our company;
    • c. automatically collect data of our website’s usage via your browser’s cookies;
  • 3.2.3 Personal Data we receive from third parties: From time to time, we will receive Personal Data about you from third parties.
4. Purposes and Legal Basis for Collection, Use or Disclosure of Personal Data

4.1 We collect, use and disclose the Personal Data for the following purposes and any other related or associated purposes (collectively, the “Purposes”):

  • To provide and maintain our Service;
  • To notify you about changes to our Service;
  • To allow you to participate in interactive features of our Service when you choose to do so;
  • To provide customer support;
  • To gather analysis or valuable information so that we can improve our Service;
  • To monitor the usage of our Service;
  • To detect, prevent and address technical issues;
  • To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information;
  • For participation of and arrangement of activities or events;
  • For administrative purposes, such as accounting, risk management, record keeping;
  • For staff training;
  • For other purposes that we notify you of, or will be clear from the context, at the point the Personal Data is first collected.


4.2 We may use Personal Data to contact you for the above Purposes via post, fax, e-mail, SMS, telephone or any other means.

4.3 We process your Personal Data under any of the following lawful basis:

  • The consent of the data subject has been obtained;
  • It is necessary for the performance of a contract to which the data, or in order to take steps at the request of the data subject prior to entering into a contract;
  • It is for preventing or suppressing a danger to a Person’s life, body or health;
  • It is necessary for compliance with the law by the Data Controller;
  • It is necessary for compliance with the public policy; or
  • It is necessary for the legitimate interests of the Data Controller or any other person where such interests override the fundamental rights of the data subject.
5. Personal Data processing

After we have received the Personal Data from the source of Personal Data, we will proceed with your Personal Data as follows:

5.1 We will process personal data lawfully, fairly, and transparently and take into account the accuracy of personal data.

5.2 We will not sell personal data that you provide to any third party without your consent.

5.3 We may disclose your personal data in connection with the Purposes, including to third parties who provide services to us or whom we work with.

5.4 We may also disclose your personal data to third parties where required or permitted by law.

5.5 We disclose your personal data with others only in accordance with applicable laws. Thus, where law requires your consent, we will first ask for it.

6. Maintenance and retention period of Personal Data

6.1 Maintenance of Personal Data
The data controller shall maintain your Personal Data as follows:

  • 6.1.1. The personal data was collected by method of soft copy and/or hard copy depending on the Purposes.
  • 6.1.2. The Company shall implement appropriate, necessary security measures for preventing the unauthorized or unlawful loss, access to, use, alteration, correction or disclosure of Personal Data. The Company shall also provide appropriate, necessary supervision over its employees, and subcontractors to ensure the protection of personal data.
  • 6.1.3. The collection period shall be in accordance with the clause regarding the Personal Data processing period.
  • 6.1.4. The Personal Data is accurate, up-to-date, complete, and not misleading.
  • 6.1.5. After the collection period has expired or we do not have the right or do not have a lawful basis to process your Personal Data, we will destroy such Personal Data and will complete it on the expiry date of such collection period.


6.2 Retention period of Personal Data

  • 6.2.1 The Company will retain personal data for the period necessary to fulfil the Purposes for which the Personal Data was collected in compliance with our obligations under Thai laws. After such period, we will destroy such Personal Data from our archives without notice or any further liability.
  • 6.2.2 The retention period will vary depending on the Purposes for which the Personal Data was collected. Where any Personal Data is only useful for a short period (such as for a specific event, marketing campaign or recruitment purposes), we may delete it at the end of such period.
  • 6.2.3 You have the right to request us to delete the Personal Data in some circumstances. Please note that we are sometimes legally obliged to retain your Personal Data, for example, for tax and accounting purposes.
7. Rights of the data subject

You have the rights to proceed as follows:

7.1. Right to withdraw consent: you have the right to withdraw consent for the processing of Personal Data that you gave consent to our company at any time that your Personal Data is kept with our company;

.2. Right of access: you have the right to access your Personal Data and request our company to make a copy of such Personal Data, as well as, request our company to reveal the obtainment of the Personal Data that you do not give consent to our company for you;

7.3. Right to rectification: you have the right to request our company to rectify incorrect data or incomplete data;

7.4. Right to erasure: you have a right to request to delete or destroy your personal data, or to cause your personal data to be unidentifiable as to who is the owner of said personal data with certain reason;

7.5. Right to restriction of processing: you have the right to suspend the use of your Personal Data with certain reason;

7.6. Right to data portability: you have the right to transfer your Personal Data that is kept with our company to other data controller or to yourself with certain reason; and

7.7. Right to object: you have the right to object the processing of your Personal Data for certain reasons. In the case you has exercised the right of objection, we may not collect, use, or disclose said personal data further. We will separate said personal data from other data clearly forthwith when you has notified the personal data controller of the objection.

You may contact Legal Department of our company to proceed with the application of claim in accordance with the foregoing rights via legal@nissinthailand.com or you may find other relevant information from Ministry of Digital Economy and Society’s website http://www.mdes.go.th In this regard, you are not required to pay any fee in order to proceed with the foregoing rights. We will consider and inform the result of your claim within 30 days from the date we have received such a claim.

8. Revision on the Personal Data protection policy

We will review the privacy policy on a regular basis to comply with the guidelines and relevant laws and regulations. If the privacy policy is changed, we will notify you by updating the information on our website as soon as possible.
